One of the major steps in the lives of transgender people is establishing official documentation that attests to their identity as men, women or non-binary (third gender) persons. Transgender people are often subjected to further embarrassment, harassment and discrimination if their documentation does not match their gender presentation.
UPDATE Jan 2026:
With states and districts slowly catching up with the process for name and gender change outlined in the National Portal for Transgender Persons, we still encounter quite a bit of variability, depending on how familiar the authorities at the District Collectorate are with the steps. In some some states and districts, community members and groups have been able to sensitize the Collector and orient the persons in charge of the IT systems on the process. However we still encounter problems such as: 1. Some applicants have been asked to obtain Section 6 (gender marker T) first before applying for Section 7 (gender marker M or F), while others have been issued Section 7 directly on submission of Letter of Medical Intervention, even without applying for a Section 6 ID.
ii. Individuals being asked to produce a surgery certificate for binary name/gender change even if they have uploaded a Letter of Medical Intervention as per the Trans Rules (2020). Note that the Act (2019) required proof of gender affirmation surgery but this was modified to Letter of Medical Intervention which can be from a mental health professional, endocrinologist or surgeon – G.A.S. is not a must.
iii. Refusal of authorities such as UIDAI and passport authorities to accept the National Trans ID as sufficient documentation for name and gender change in Aadhaar, PAN and passport.
